I don't claim to know a thing about trademark law, but looking at this simply I find it difficult to understand how the term "Windows" can become a trademark but "App Store" cannot.
Windows is a trademark. Microsoft sued Lindows because of the similarity, then ended up paying them $20,000,000 to go away when it looked as if Microsoft could lose the trademark. And Apple owns "App Store". Microsoft just wants to use the name.
And a company named ContainerStore owns the trademark on the word "Container Store" !!!!
That linguist obviously says what Microsoft wants him to say. Which is the truth, but not the whole truth. The whole truth would mention that the term "App Store" was not used by anyone before Apple used it and wouldn't be used by anyone if Apple hadn't used it.

I can't, but maybe these guys can/will.
That's what I'm hoping. I'm leaning towards the SLA being the answer for this.

What would you do if someone was shooting at you?
...Eh, shoot back? But not in the head... A head shot, geez... That wasn't meant to stop him, that was meant to kill him...

Awesome. I want a current MBA, but they're a tad too much right now. This will lower those prices.

It seems that App on its own is generic, but the combination with another word to define a particular thing is not... see

Too bad Apple had to pay when, IMO, they didn't really infringe on a patent.
Either Apple believed they did and/or was afraid of further damages the court could award. If Steve thought he could invalidate the patent, he would not have settled.

I've been hoping for this for a long, long time. I would love for this to be in the cards, but it just seems too different from iTMS to be announced. But hope springs eternal....

That would leave an awful lot of parents dead.
Not you, the poster you were quoting was being sarcastic. I was drawing your attention to his sarcasism.
Oh, sorry :) I had thought he was being rude towards me.

Kentsfield is Intel's next revision of their "Core" processors which was originally scheduled to be released in the 1st Quarter of 2007. According to the article, it is now planned for late 2006 availability.
Uh, you guys reported this part (http://www.macrumors.com/pages/2006/07/20060720090504.shtml) some time ago.

Dell currently quotes 9-22. Or did yesterday when I placed an order.
Just checked again. It does appear that laptops are ready to go on 9-22, 9-25, and 9-27, depending on which model and size. Still, that gives Apple some "breathing room" to release theirs.

I do agree that the look of the current enclosure is great, and it's doubtful we'll get a change to the look of the enclosure anytime soon. However, I can see them changing the enclosure to match up more with what the regular MB allows, i.e. easy access to the HDD bay so users can swap out hard drives ease. Now that would be nice.
sure, I agree that minimal changes might happen. If it improves the experience, why not.
A total redesign case is what I doubt. It will take some time. I would say at least 1 year from now.
Same for the entire line up. Imac, MacPro, laptops, Mac Mini, displays, etc. Apple's current hardware design is very nice. Besides minor improvements, big changes will take some time IMHO.

Microsoft struck back ... saying "the compound noun 'app store' means simply 'store at which apps are offered for sale,' which is merely a definition of the thing itself--a generic characterization."
Therefore, the compound name "Microsoft" must simply be a soft thing that is becoming micro in relevance (and business ethics)...

So no one would have been able to shoot the 19 people who were shot (and 20 injured) in Tucson? Perhaps not the first one or two or even three, but eventually someone would have been able pull out their gun and take out the guy before he got to 5 let alone 19 or 20.
It happens quite often when there are people with CC permits around, it just isn't reported as often as the nut job - who already was a criminal - pulls out a gun and kills innocents.
It might have just happened here too - the who knows where three armed robbers were headed next. They found the 2 in a residential area and closed schools near there.
And for the people wondering, Chula Vista isn't a very nice area and I'm not surprised that guards who are guarding the area (it is not a completely inside mall if memory serves) were carrying guns at night.
[edit]:
The rules I was taught:
1. There is no such thing as an unloaded gun.
2. Never point a gun (toy or otherwise because you may be wrong about it being a toy) at anyone unless you intend to kill them - because in the heat of the moment you may do so even if you intend to do something else.
Or take the incident in Tucson with the congress woman. No one would have stopped that with a gun either. It doesn't work like that.

Published in USA today. An article titled "Are Lives Really an Acceptable Price for Fuel Efficiency?"
DDT's effects on malaria are well established, and the consequences of banning DDT in 1972 are also pretty widely accepted. People disagree, however, on whether it was a good thing or not.
and SuperCachetes, I was under the impression that US jobs were going out of the country bc we can't afford Union price tags. But if you "think" making labor more expensive will spur hiring, then keep "thinking" that with your "brain" ;)
Meanwhile, I'll be earning my degree from a top 25 university so that I can get a job that affords healthcare for my children
You're new here so please take a moment to read the rules. One of them quite clearly states that you need to provide links to relevant articles.
Thank You.

Every cell phone is tracked .... don't know how many store it on the local device (out of reach for anyone except you), but the tracking data from every cell phone is stored on the providers servers and/or government servers - law enforcement could access that information in almost real time.
Presumably with a warrant and not on the fly at the side of the road without a warrant. Although I remember reading about some sort of site the gov has set up with the carriers where they can get info without warrants (patriot act thing).

What is it with some of you guys? Does hope spring eternal, or what!
Apple could be at a medical convention to promote the new artificial Apple iHeart and some of you would be jumping up and down screaming: "Yahoo, this means MBP updates".
LOL - "oh, and one more thing ... the iHeart!!!" I love it!!!

Personally, I really would like to see all day battery life from the new MBA instead of cpu upgrade. That would make the air a must buy.
