The DREAM Act could come up for a cloture vote as early as this week, but faces tough opposition from Republicans -- including a few who, like McCain, previously supported the bill.
Some will likely vote against the DREAM Act citing timing. Senate Majority Leader Harry Reid (D-Nev.) plans to bring up the bill for a cloture vote as early as Wednesday, but all 42 Republican senators have said they would filibuster any bills not related to tax cuts.
As the Senate struggles to come to agreement on the tax cuts and other issues, the DREAM Act could lose its few Republican supporters. Sen. Richard Lugar (R-Ind.), a co-sponsor of the DREAM Act, would vote against the bill if it came up this week, spokesman Mark Helmke said.
"You have to handle the spending bills, tax legislation and START first," Helmke said. "If we get those three things, he's willing to stay in and take up the DREAM Act."

Hello,
Honesty is almost always the best option.... here would be my answers:
1. I came to US for work and have found US to offer challenging work environment full of opportunities. After working for 6 years, I would like to upgrade my skillset and hence, the decision to go for education
2. In this global economy, it is hard to plan exact details, but I believe that with my US experience and added education, I should find a rewarding position anywhere in the world
3. I've attached the papers of my home in Pakistan where I intend to return in the long run, but most probably I'll have to move to the place where I'm offered the job after my education
Of course, there is no gurantee that the USCIS will respond positively to honesty, but at least your friend's conscious will always be clear.... good luck to her!

The only document that I know that suit the name " Unemployment Wage Report" is IRS Form 940-Employer's Annual Federal Unemployment (FUTA) Tax
Return.
The probable reason of asking-to verify, that Company is sound, paying salary, wages, then taxes, including unemployment tax.
The company's Tax Return also shows how's company doing financially,economically, if it able to pay their employees salaries and what business this company stated as her primary.
Therefore, I think, that asking for these docs seams as reasonable, keeping in mind that consulates and embassies belong to different department than DHS and USCIS.

I'll give you a honest answer. Consult an attorney and find a fool proof step, if there is one. Although, I'm inclined to say, stay F1 and bring her as F4. You need much more than that.

I've not get EAD and AP and been waiting for last few months. My wife got both EAD and AP. Is it good idea to call USCIS I/O about my status of EAD and AP? I applied for all 485/EAD/AP in june last week and got the notice on Aug 15th. Please check my signature for more information.

Your qoute about immigration is absolutely fabulous !!, that made my day !!:D, I wish all American Indian should now give visa's to everyone who is here already...
She does not need to do anything but get a job, fill form I-9 and start working again. She is in a period of authorized stay since her I-485 is pending. I don't think it's even necessary to apply H4 for her.

pnagar: (1) Employment Verification Letter with your Job roles, responsibilties, which should match/similar to your GC labor; and your annual income. (2) Once your 140 is approved and 180 days have passed after filing 485; it will not affect you even if your employer withdraws the 140 application. It will affect only if USCIS revokes based on fraud grounds.
For the PD of 07, it is a long way to GC with out the help of organization like IV - If you have time, take look at the omnibus fund raising and help in anyway you can.

Gurus,
I have a question. I am a July 2nd 485, EAD, AP filer and I did not receive my AP yet. My H1 visa stamping got expired, and I am planning to go to India for 2 months. Can I leave US before my AP gets approved, hoping that it will be approved in the next 2 months time and my attorney will send the AP papers to my India address?
Is it possible, please advice.

There is no official documentation for to do's and to not do's without AP.
But folks have gone to India without the AP and then got it fedexed while In India and used it to get back to US.
My brother in law did the same. I am not aware of the potential issues he might face in the future but will post so when something happens.

USCIS might re-start PP for I-140 once they complete receipting 485 applications and EAD, AP approvals for July and August filers..which may take atleast 3 to 4 more months!!

Hi, guys,
I'm having a little trouble with counting the years of experience for my EB2 petition. My attorney said I can only count the number of years I worked before joining the current sponsoring company!! The situation is, I jointed this company in Jan 2004. But my petition (Labor) appliction only started at the end of 2006. My attorney says that the three years of working experience (04, 05 & 06) can not be counted!
Is he correct on this?

This change will allow Iranian students and exchange visitors to travel more easily, furthering our goal of promoting the free flow of information and ideas. This important decision is being taken as the global community witnesses the Iranian Government�s increasing censorship and isolation of its own people.
Iranians currently in the United States on a three-month, single-entry visa in one of these categories must reapply outside the United States at a consular post in order to obtain two-year, multiple-entry visas. Keep in mind that the validity of a visa refers to the time period the visa holder has to enter the U.S. It has no bearing on the length of stay permitted by U.S. Customs and Border Protection officials at the port of entry. Iranian students and exchange visitors in good standing in the United States do not need to apply for a new visa until after they depart the United States.
